Welcome to SHOPHUNA. These Terms and Conditions ("Terms and Conditions") govern your use of the SHOPHUNA website and related services provided by or through SHOPHUNA ("we", "our", "I"). SHOPHUNA is a website owned and operated by Innovative Marketing Services LLC, a company registered in the Hashemite Kingdom of Jordan under number (69425), facilitating orders by connecting buyers with sellers who offer their services and display their goods through the Website. By accessing or using SHOPHUNA, you agree to comply with these Terms and Conditions. If you do not agree to these Terms and Conditions in whole or in part, please do not use the Website. When visiting or using the Website, your information will be processed by SHOPHUNA for the purposes set forth in SHOPHUNA's Privacy Policy. Your acceptance of these Terms and Conditions also signifies your consent to the Website's Privacy Policy (Privacy Policy link) and that you grant the Website and its owners and operators the right to process your personal data in the legal sense of the word.

Wherever the following words and phrases appear in these Terms and Conditions or in any terms, provisions, or policies published on the Website, they shall have the following meanings unless the context indicates otherwise:

  • (“Mobile Application”): Refers to a mobile application (Application) that can be used on mobile devices such as smartphones and tablets, offering the same features and basic functionalities available on the Website.
  • The reference to (“Website”) also means a reference to (“Mobile Application”), and the reference to (“Mobile Application”) also means a reference to (“Website”).
  • The references to (“Website”) or (“Mobile Application”) also mean a reference to the company owner and Website operator.  
  • (“Company”): Refers to Innovative Marketing Services LLC, a Jordanian limited liability company registered under number (69425) and it is the owner and operator of the Website.
  • (“Personal Data”): Means any information provided by users or collected by SHOPHUNA, including but not limited to personal information, contact information, and any other relevant information.

 

  1. Acceptance of Terms and Conditions 

By creating an account on the Website and/or using the Website without creating an account, you shall agree to comply with these Terms and Conditions as one unit, constituting an agreement between you and the Website. You shall acknowledge and agree that the website has the right to modify or cancel any of these Terms and Conditions and any other terms, conditions, and policies related to the website at any time and periodically without prior notice, knowing that modified Terms and Conditions will be published -if modified- on the website and shall be in effect from the date of their publication on the website. Furthermore, continued use of the website after the modification of the Terms and Conditions constitutes acceptance of those modifications. The company also shall retain any right or compensation that may accrue to it regarding any breach, right, or obligation that may have occurred before the cancellation or modification of the Terms and Conditions.

  1. The buyer is not required to register an account on the website in order to browse the website. However, depending on your use of the website, we may require you to create an account and agree to these Terms and Conditions, as well as any other terms, conditions, and policies to continue using the website.
  2. In order to create an account, you shall have the legal capacity that allows you to exercise your civil rights.  
  3. In case you do not have the legal capacity to exercise your civil rights, you shall be obligated to obtain permission from your legal guardian or representative -as appropriate- and ensure that they have read and agreed to these Terms and Conditions. If you do not have legal capacity, some services may not be available to you without the consent of your legal guardian or representative to these Terms and Conditions.
  4. Each buyer shall have the right to own only one account on the Website, and any duplicate accounts will be deleted by the company.
  5. The Website is not responsible for any unauthorized access to the user’s account by any third party, nor it is responsible for any unauthorized use of the user’s data by any other party. 
  6. The user shall agree not to use their account for any purposes or activities that violate the law, public order, or public morals. The user alone shall be responsible for any use of their account in any form.
  7. In the event of the user’s failure to comply with any provision of these Terms and Conditions or if it is found that the user has violated any of the terms required to create the account, the website shall have the right to immediately cancel or suspend the account without any prior notice.

  1. The user shall be responsible for maintaining the confidentiality of their account information, including their account password. The user must immediately notify us if any unauthorized third party becomes aware of their account password or if there is any unauthorized use of the account or any security breach that may affect the user’s account.
  2. The user shall agree that we are not responsible for any liability if any person to whom the user has disclosed their account password accesses or uses the account in any way. Furthermore, we are not responsible for any unauthorized access to the account in any form.
  3. We reserve the right to suspend or delete accounts for security reasons or for any reasons we deem necessary without providing any notice thereof.

 

  1. Quality and Guarantee of Goods
  1. The buyer shall acknowledge and understand that the website shall not be responsible for any defect that may exist in the goods provided by the seller, whether it is an apparent or latent defect or a substantial or non-substantial defect, and in general any defect regardless of its type, cause, nature, and effect.
  2. The buyer shall acknowledge and understand that the website shall not guarantee the quality and standard of the goods provided by the seller, and the buyer shall not entitled to claim any damages that may result from any purchase made through the website.
  3. The website shall not be responsible for any requests for the return of goods or the refund of amounts paid by the buyer, and this relationship is confined between the seller and the buyer.

The seller shall agree to allow the website to use the trademarks, trade names, and all intellectual property rights owned by the seller that are visible on the goods. Accordingly, this provision constitutes an absolute and unrestricted license for the website to use the referenced intellectual property rights. The seller shall also acknowledge that they are the owner and/or authorized user of the trademarks, trade names, and intellectual property rights displayed on the goods, and otherwise, the seller alone bears any legal responsibility that may arise therefrom.

 

  1. Use and Processing Data 
  1. By using SHOPHUNA, you shall agree to use your personal data in accordance with SHOPHUNA's privacy policy.
  2. SHOPHUNA has the right to collect all types of data, including but not limited to personal data, contact data, and any other relevant data.
  3. By using SHOPHUNA, you shall acknowledge and agree that SHOPHUNA may transfer your personal data and contact data to the seller or any third party inside or outside the Hashemite Kingdom of Jordan for the purpose of completing any commercial transactions or providing any services.
  4. The user shall acknowledge that SHOPHUNA may transfer your data to servers or parties located outside the countries where the data is collected and processed. By using SHOPHUNA, the user shall agree to these cross-border transfers.
  5. The user shall acknowledge and agree that their information may be processed in accordance with our privacy policy, which you must comply with.

SHOPHUNA and/or its websites and/or applications, and/or affiliated companies may contact you from time to time via SMS, email, or phone notifications regarding your account, offered goods, available promotions on the website, privacy notifications, administrative messages, and other communications.

By agreeing to these Terms and Conditions and providing us or our affiliated companies with your phone number and email address, you consent to receive SMS messages and/or email communications from or on behalf of the website or any of its affiliated websites and/or applications and/or companies.

 

  1. Termination of Services 

The website shall be entitled to close, suspend, or delete your account for any reason it deems appropriate, including but not limited to the violation of these Terms and Conditions or any terms, conditions, or policies published on the website.

 

  1. Limitation of Liability 
  1. SHOPHUNA is a website that facilitates the delivery of orders by connecting sellers with buyers. Therefore, the website shall not be responsible for any errors related to the goods, including but not limited to the sellers’ failure to comply with specified deadlines, technical errors, manufacturing defects in any of the goods, hidden defects, poor storage, or any other defects in the goods. SHOPHUNA shall not bear any responsibility for such errors.
  2. The buyers shall acknowledge that SHOPHUNA is not a seller and does not control the behavior of sellers. Additionally, SHOPHUNA shall not be responsible for any direct or indirect damages resulting from sellers.
  3. The user shall agree to release  the website and its owners, affiliated websites, mobile applications, companies, successors, agents, and employees from any claims, losses, liabilities, costs, or expenses arising from or related to, including but not limited to:

 

  • Any defects in the goods provided by the sellers.
  • Seller's failure to comply with specified deadlines.
  • Technical errors by sellers.
  • Any other errors committed by sellers.

 

We do not provide any commitment or guarantee and do not bear any responsibility for any goods purchased or obtained as advertised on the website.

 

  1. Payment Terms 

The buyer shall agree to the following terms regarding payment for the goods:

  • Buyers shall make payment for the goods through the payment methods provided by the website, whether in cash or by credit card.
  • The buyer shall acknowledge and undertake to provide accurate and up-to-date payment information.
  • SHOPHUNA is entitled to suspend or cancel commercial transactions if payment information is inaccurate or outdated.
  • During the booking process, buyers will be clearly informed of the cost of commercial transactions including fees, costs, and delivery charges.

  • We reserve the right at any time to:
  1. Add taxes to any of the goods, in accordance with applicable laws.
  2. Suspend or terminate any payment method, anywhere in the world, in a particular country, or in relation to a specific section.
  3. Impose fees or modify them regarding the use of any payment method.
  4. Impose a currency transfer fee regarding payments made in currencies other than those we accept.
  5. Change the terms and conditions associated with any payment method.
  6. Change the method by which the user may pay for any of the goods.
  • We reserve the right to refuse any payment received or seize any amounts we believe have been paid or obtained by unlawful means, whether directly or indirectly without the need for notice.

 

  1. Applicable Law and Jurisdiction 

These Terms and Conditions are subject to the laws of the Hashemite Kingdom of Jordan, and disputes arising from or regarding these Terms and Conditions shall be resolved by resorting to the courts of the Hashemite Kingdom of Jordan with the Palace of Justice (Amman, Jordan) having jurisdiction and authority.

  • If any provision of these Terms and Conditions is found to be unlawful or deemed unlawful by the competent court, either in whole or in part or if it becomes unenforceable, the validity of the remaining provisions shall not be affected and shall remain in full force and effect.
  • Failure to execute any provision of these Terms and Conditions does not constitute a waiver of our right to enforce such provision at any later time.

 

These terms have been adopted in both Arabic and English languages, and in the event of any differences between the two languages, the Arabic language shall prevail.
